The decision ends a multi-year review into tobacco and menthol flavored products.
The Food and Drug Administration (FDA) determined that Juul can continue selling its tobacco and menthol flavored e-cigarettes and refill cartridges, ending a years-long review into the products’ impact on public health.
In 2022, President Biden’s administration banned Juul’s popular products, saying that there was “insufficient and conflicting data” about “potentially harmful chemicals leaching from the company’s proprietary e-liquid pods.” However, less than two weeks later, the FDA suspended the ban, telling Juul it could continue to sell its products while the agency carried out a review.
In June 2024, the FDA formally rescinded the ban and placed Juul’s application in a “pending status,” opening the door for a potential authorization, which the agency finally approved.
An FDA spokesperson said that the authorization does not mean that the products are safe or “FDA approved,” but that Juul had submitted enough evidence that its new nicotine products were “appropriate for the protection of public health,” meaning that use of the product is less harmful than cigarette smoking.
